Abstrak

Sejak pemilu pertama tahun 1955 hingga Saat ini, terutama sejak diberlakukannya sistem pemilihan langsung kepala daerah, persoalan netralitas birokrasi dan penyalahgunaan kekuasaan semakin mengemuka, Kehadiran norma padal 71 LILI nomor 1 tahun 2015 menjadi instrumen hukum untuk memastikan netralitas birokrasi dan mencegah abuse of power. Namun upaya penegakan hukumnya seringkali mengalami kendala karena adanya perbedaan persepsi dan penafsiran diantara para penegak hukum. Bagaimana penafsiran hukum terhadap beberapa frasa yang dipergunakan dalam pasal 71 ini? Peneliti mengkajinya dengan menggunakan pendekatan conceptual approach yang dipadu dengan Studi atas beberapa putusan pengadilan. Peneliti menemukan bahwasannya norma Pasal 71 dimaksudkan untuk menjaga marwah birokrasi agar dapat tetap mempertahankan netralitas dan professionalismenya. Penggunaan delik formil dalam memaknai frasa "menguntungkan atau merugikan " ( ayat (I) dan (3)) sangat penting untuk mencegah praktek penyalahgunaan sumber daya negara untuk kepentingan politik elektoral. Sedangkan ruang lingkup pemaknaan atas frasa "petahana" (ayat (2) dan (3)) sebaiknya dimaknai dalam arti luas.
